Identification & Age Requirement |
We require 2 (two) forms of identification when picking up the equipment
for hire with 1 (one) form of ID showing a photograph. (i.e. Drivers
License or Passport)
Also required is the hirer's current residential address and contact
details for the next of kin.
The driver of the towing vehicle to be older than 25 years of age
and no older than 70 years of age.
The hirer must supply Vehicle Registration Number of the towing vehicle
and details of the insurance company covering the towing vehicle.
Driver of the towing vehicle is to hold a valid Australian or International
drivers licence, that has no warrants, orders or judgements that would
lead to cancellation of the drivers licence. |

Booking Fee |
We will tentatively book over the phone, fax or online and hold
that booking for a period of 48 hours. A Booking fee of $100.00 deposit
paid to confirm the booking. |
| 3. |
Cancellation |
In the event of cancellation, we will refund 75 % of the booking
fee to the hirer, if notified 28 days or more prior to the commencement
date of the Hire Period, 50% if notified 14 days or more prior to
the commencement date of the Hire Period, otherwise the entire booking
fee is forfeited.
If however it is a last minute cancellation and your balance has been
paid, we will endeavour to rebook the camper trailer on your behalf.
Any part of the hire that cannot be rebooked will be charged for.
If you have Travel Insurance this would cover this payment. |
| 4. |
Bond |
A $500.00 cash bond or credit card is required
on pickup of the camper trailer (this bond covers incidentals such
as canvas damage, tyre damage and cleaning costs if required). If
you are going to the Cape or taking the camper trailer outside of
Queensland we will require a $1000.00 bond and an itinerary of planned
trip. The Hire Agreement will not proceed if the bond is not paid.
The bond will be refunded within 7 days (either by cash, cheque or
reversed credit card) from the time the equipment has been returned
less the cost of any missing equipment. |

Hire Rates |
The hire rate shall be payable 3 (three) weeks in advance for each
hire period in respect of the camper trailer or any other equipment
hired by the hirer. If paid 5 (five) working days or more in advance
the hire rate may be paid by personal cheque. Otherwise, if paying
when collecting the camper trailer or any other equipment hired, the
hire rate must be paid in cash, money order or with a bank cheque. |

Hire Period |
The hirer will be charged for all equipment hired at a "time
taken" period and not a "time used" basis. Hire of
our camper trailers is for the agreed time only, while every effort
will be made to accommodate extensions to the initial rental period,
we cannot guarantee that an extenuation of the rental will be achieved.
Pickup and returns must be done between 9.00am - 5.30pm Monday to
Friday and 9.00am - 12noon Saturdays. We are closed on Sundays and
Public Holidays. A late fee will apply if goods are returned outside
these times. Camping Under the Stars offers a delivery and pickup
service for a small fee in the Brisbane metropolitan area. |

Payment |
We accept payments in Cash, Credit Card, Personal Cheque, Bank Cheque,
Money Order and Direct Deposit (will provide account details upon
request) |
| 8. |
Early Return |
There are no refunds, partial or otherwise, and no future credit
accrued as a result of early return of the camper. |
| 9. |
Late Return |
Late Returns will be charged at a full daily hire rate following
the date of booked returned date. |
| 10. |
Hirer Responsibilities |
The hirer agrees that before hire, all equipment is cleaned and
maintained (in good working order and condition) to our schedule and
should be returned in the same condition.
The hirer agrees to return the camper trailer to you on the due date
at the location where the camper trailer is to be returned to, unless
being picked up by "Camping Under the Stars".
The hirer agrees that if the camper trailer is not returned by the
due date or if hirer has terminated this Agreement you may report
to any Police Officer the camper trailer as being stolen or unlawfully
use.
The hirer will not use the camper trailer or any other equipment hired
for any purpose other than for which it was designed and use this
equipment in a reasonable and proper manner.
The hirer shall not make any repairs, modification or alterations
to the equipment nor deface, erase or alter any identifying mark,
symbol, plate or number in or on the equipment.
The hirer shall not make any addition or alteration to the hired trailer
nor load or encumber the hired trailer in any manner whatsoever to
cause Aggregated Trailer Mass or the Gross Trailer Mass to exceed
the regulation limit for which the trailer is registered.
The hirer shall not loan, sell, nor offer for sale, nor mortgage,
pledge, sublet, assign or part with possession of the hire equipment
during the hire period without the consent of "Camping Under
the Stars" first hand in writing.
The hirer to pay any traffic and parking violations in respect of
the camper trailer incurred during the term of this Agreement.
The hirer will pay any parking and storage costs of the camper trailer
during the term of this Agreement.
The hirer will specifically reimburse "Camping Under the Stars"
for all damage or injury to the camper trailer caused by water whether
due to a water crossing, partial or total immersion in water or any
other fluid, and not make any unsafe or impractical water crossing.
The hirer will follow any specific instructions which may be issued
to you regarding traversing of rocks or rocky outcrops or beaches.
The hirer will comply with all relevant laws, regulations, rules,
by-laws and ordinances for the use of the camper trailer and pay any
fees and charges. |
| 11. |
Cleaning |
When I return the camper trailer it will be clean, in good working
order and condition with all tools, spares and accessories fair wear
and tear accepted. I will pay you a cleaning fee of $50.00, if the
camper trailer or any other equipment hired is returned unclean, at
the discretion of the owner out of the bond.
Marks on the canvas are to be wiped off with a cloth and water only.
(No cleaning chemicals are to be used on the canvas as this may damage
the waterproofing properties of the canvas) |
| 12. |
Repossession of Asset |
In the event that the equipment is not returned by the due return
date the owner shall be entitled to apply to wait court of competent
jurisdiction in any State or Territory of Australia or to a Federal
Court of the Commonwealth of Australia for an order requiring the
return of all the equipment or allowing the recapturing of the equipment
and the hirer shall hearing agreed, to pay the owners legal costs
on an indemnity basis associated with recovering the equipment and
any economic loss incurred. |
| 13. |
Damage |
The hirer understands and agrees that, "Camping Under the Stars"
and any of its known affiliates are not accountable for any costs
incurred to the hirer as a result of damage to or theft of any of
our equipment during the period of hire. This includes costs such
as accommodation, meals, flights, car hire, phone calls etc or any
other costs incurred. All damages to our equipment while in the possession
of the hirer must be reported immediately to the management of "Camping
Under the Stars". All damages sustained to the camper while in
the possession of the hirer shall become the sole responsibility of
the hirer to repair to a condition at least equal to the condition
of the equipment as existed prior to the damage and or theft event
occurring. All repairs are to be undertaken only as authorised by
the management of "Camping Under the Stars" using qualified
service personnel nominated by "Camping Under the Stars".
All costs for repairs required as a result of damage while on hire
shall be paid for by the hirer and will pay rentals on the equipment
at the regular rental rates until repairs are completed. Under no
circumstances shall any third party be engaged, or act on behalf of
the hirer for the purpose of repairs unless specially authorised in
writing by "Camping Under the Stars". |
| 14. |
Indemnity |
The hirer agrees to use, operate and posses the equipment at the
Hirer's risk. The hirer agrees that "Camping Under the Stars"
will have no responsibility or liability for any losses or damage
to the property of the hirer. To the full extent permitted by the
law the hirer releases, discharges and indemnifies "Camping Under
the Stars" from all claims and demands on "Camping Under
the Stars" arising out of or consequent on the use or misuse
of the goods during the hire period. |
| 15. |
Insurance |
A $1000 excess is payable by the hirer in the event of an accident. |
